These Terms & Conditions (the “Terms”) govern your access to and use of articulatevision.net (the “Site”) operated by Articulate Vision LLC, a Utah limited liability company (“Articulate Vision,” “we,” or “us”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

Services on the Site vs. engagements

The Site provides general information about Articulate Vision and a way to contact us. Nothing on the Site is an offer or a contract for services. Any engagement with Articulate Vision is governed by a separate written agreement (a statement of work, master services agreement, or proposal) signed by both parties.

Acceptable use

You agree not to:

  • Use the Site to violate any law, regulation, or third party right.
  • Reverse engineer, decompile, scrape, or attempt to extract source code from the Site except as expressly permitted by law.
  • Submit malicious code, attempt to bypass authentication, or interfere with the Site’s operation.
  • Misrepresent your identity in a form submission, or submit content you do not have the right to share.

Intellectual property

The Site, including text, graphics, layouts, logos, the Articulate Vision brand mark, software, and any other original content, is the property of Articulate Vision LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and link to the Site for personal, non-commercial purposes. Any other use requires our prior written permission.

Third party links and content

The Site may link to third party websites or content that we do not control. We provide those links for convenience. We are not responsible for the content, policies, or practices of any third party.

Disclaimer of warranties

The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Articulate Vision disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from a course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components.

Limitation of liability

To the maximum extent permitted by law, Articulate Vision will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our aggregate liability for any direct damages arising out of or related to your use of the Site is limited to one hundred U.S. dollars (USD $100).

Indemnification

You agree to indemnify and hold harmless Articulate Vision, its officers, members, employees, and contractors from any claim, liability, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Site or your breach of these Terms.

Governing law and venue

These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of those courts.

Privacy

Our handling of information collected through the Site is described in the Privacy Policy, which is incorporated into these Terms by reference.

Changes

We may update these Terms from time to time. The “Last updated” date at the top of the page reflects the most recent revision. Continued use of the Site after a change means you accept the updated Terms.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
